Belovity Terms of Use

IMPORTANT — PLEASE READ. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER AND A JURY-TRIAL WAIVER. THEY REQUIRE MOST DISPUTES BETWEEN YOU AND BELOVITY LLC TO BE RESOLVED BY INDIVIDUAL ARBITRATION RATHER THAN IN COURT. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS. See "Dispute Resolution, Arbitration, and Class-Action Waiver."

NOTICE ON AGE: Belovity is for adults 18 and older. You must be 18 or older to create or hold an account. If you believe a person under 18 has created an account, contact alex@belovity.com and we will address it.

Belovity is operated by Belovity LLC ("Belovity," "we," "us," "our"). These Terms of Use ("Terms") apply to the Belovity web application and installable progressive web app at app.belovity.com (the "Service") and to our website at belovity.com (the "Site"). They incorporate our Privacy Policy (https://belovity.com/privacy) and Cookie Policy (https://belovity.com/cookies).

1. Agreement to These Terms

These Terms are a binding contract between you and Belovity LLC. By visiting or browsing the Site, or by creating an account, signing in, or using the Service, you acknowledge that you have read and agree to these Terms, the Privacy Policy, and the Cookie Policy. If you do not agree, do not use the Site or the Service. We present these Terms for acceptance when you create an account — the account is not created until you accept — and we record that acceptance; see Changes to These Terms for how later versions are presented. Your use of the Site also constitutes acceptance.

2. What Belovity Is

Belovity is a private family space where a family creates a "Family Page" and builds gift lists and wishlists ("Gift Lists") to share with invited friends and relatives. Gift Lists are sometimes called registries; these Terms use the two terms interchangeably. Belovity is a Gift List and wishlist tool. Belovity is not a store, not a merchant, and not a party to any purchase you or your guests make from any retailer.

3. Eligibility and Age

You represent and warrant that you are 18 years of age or older. Accounts are for adults only. People under 18 do not hold Belovity accounts. Belovity is a general-audience service and is not directed to people under 18. Content on Belovity is created and uploaded by adult account holders.

If we learn that an account is held by a person under 18, we may suspend or remove it. If you believe a person under 18 has created an account, contact alex@belovity.com and we will address it.

4. Your Account

Belovity uses passwordless sign-in. You sign in by (i) an email magic link, (ii) Google, or (iii) Facebook. Creating an account requires accepting these Terms, the Privacy Policy, and the Cookie Policy; no account exists until you do. You acknowledge that access to your email inbox is access to your account: anyone able to open a valid sign-in link sent to your email during its validity window can sign in as you. Keep your email account secure. A magic link remains usable throughout its validity window and is not limited to a single use.

You are responsible for activity under your account. You represent and warrant that the information you provide is accurate. Notify us at alex@belovity.com if you believe someone has accessed your account without authorization.

5. Family Pages, Roles, and Invitations

Each Family Page has three roles: Owner, Admin, and Follower. Owners and Admins hold every permission on the Family Page, including the ability to see all Gift Lists — including ones that are turned off or hold no published items — and all purchase records, and to see analytics about who viewed the Family Page. Only the Owner can delete the Family Page or manage Admins. Followers receive only the specific permissions an Admin grants them.

On a Family Page with the Unlimited plan, an Admin also controls which Gift Lists each Follower can see, Gift List by Gift List, from the Followers page, and sets for each Gift List whether people who follow later receive access to it automatically. Turning that setting on when creating a Gift List also grants access to the Followers the Family Page already has. Anyone who joins through the share link, is approved from a follow request, or is changed from Admin to Follower receives the Gift Lists marked visible to new followers.

On a free Family Page these per-Follower controls are not available, and every Follower sees every Gift List on the Family Page that is turned on. In either case, a Follower never sees a Gift List that is turned off or that has no published items, and these per-Follower controls do not apply on a public Family Page — see Family Page Visibility. Analytics about who viewed the Family Page is also part of the Unlimited plan; see Plans, Pricing, and Billing.

You acknowledge that a Family Page has a share link that admits anyone who opens it as a Follower immediately, without admin review, and that this link does not expire until an Owner or Admin regenerates it. Anyone you give the link to, and anyone they forward it to, can join. The share-link landing page displays the Family Page's avatar and the Owner's first name to anyone who holds the link. Managing and regenerating the share link is the Owner's and Admins' responsibility.

Admins may also invite people by email address. Removing a Follower or Admin immediately revokes their access, but does not delete content they already contributed (see Your Content and the License You Grant).

6. Family Page Visibility

By default, every Family Page is private. Unless you change the setting, only the Family Page's Owner, Admins, and Followers can view it. You do not have to do anything to get this protection, it applies to every Family Page, and it does not depend on any feature tier or paid plan.

Search visibility is a separate setting, it is separate from who can view your page, and it starts ON. A new Family Page is discoverable by default. Turning it off requires the Unlimited plan: the "Search visibility" control on a free Family Page prompts you to upgrade rather than changing the setting, and a free Family Page has no way to turn search visibility off. See Plans, Pricing, and Billing.

While search visibility is off — that is, on a Family Page with the Unlimited plan that has chosen to hide — we instruct search engines not to index your Family Page, and your family does not appear in Belovity's own family search. Honoring a "do not index" instruction is at each search engine's discretion, and we cannot guarantee a search engine will obey it. On a free Family Page we do not send that instruction at all.

Belovity's family search. Signed-in Belovity users can search for families. Your family appears in those results if the searcher already belongs to it, if your search visibility is on, or if your Family Page does not have the paid hide-from-search capability. This means a free Family Page is listed in Belovity's family search even when the page itself is private. The search matches on your family name and on an Owner's or Admin's name, username, or last name, and a result shows the family name, avatar, and the usernames of Owners and Admins. Appearing in a search result does not give anyone access: opening a Family Page is still subject to the visibility rules above, so a private Family Page stays unviewable to someone who finds it this way. What is disclosed is the existence of your family, its name and avatar, and the usernames of its Owners and Admins.

You can choose to make your Family Page viewable by anyone with the link, and you can separately choose to make it visible to search, in your Family Page settings. If you turn a Family Page public, an unauthenticated visitor can then see the Family Page name, description, avatar, cover image, the usernames of Owners and Admins, the follower count, and Gift Lists (item name, price, remaining quantity, "most wanted" flag, merchant domain, and the outbound link to the retailer). On a public Family Page, every Gift List that is turned on and holds at least one published item is visible to anyone with the link, and the per-Follower Gift List permissions described in Family Pages, Roles, and Invitations no longer apply. Gift List shipping addresses are not visible to unauthenticated visitors, whether or not the page is public.

The followers-only visibility setting is free and always available on every Family Page, and we will not put it behind a paywall. The separate search-visibility setting is part of the Unlimited plan; a free Family Page cannot change it and is discoverable as described above. Downgrading turns search visibility back on. If you move from Unlimited to Free, your Family Page becomes visible to search again, and you will not be able to turn it off while on the free plan. See Downgrading to Free.

You are responsible for choosing the visibility settings appropriate for your family, and you acknowledge that once a Family Page has been public or visible to search, we cannot control copies, links, or search-engine caches created during that time.

7. Your Content and the License You Grant

"Content" means anything you upload or create on the Service, including Family Page names, descriptions, avatars and cover images, Gift List names, Gift List items, product links, recipient names, shipping addresses, and gift messages. You keep all ownership rights in your Content.

You grant Belovity a limited, worldwide, non-exclusive, royalty-free license to host, store, transcode, create thumbnails of, cache, back up, and display your Content, solely to operate and provide the Service to you and to the audience you choose. This license exists only so we can run the Service. We do not use your Content for advertising or marketing, and we do not use your Content to train artificial-intelligence models. This license ends when your Content is deleted, except that (i) copies may persist for a limited period in backups and caches, and (ii) copies that others downloaded, or that persist on Family Pages you do not control, are outside our reach. 8. Content About Other People

Your Gift Lists and gift records may name or describe other people — for example, a gift recipient.

You represent and warrant that, for every identifiable person named or described in your Content, you have the right and authority to add that Content and to share it with the audience you select, and that you have that person's permission or another lawful basis.

You acknowledge that a person named or described in your Content, or someone acting on their behalf, may ask us to remove that Content even if a different family member added it. We will honor reasonable removal requests. To request removal of information about another person, or about yourself, contact alex@belovity.com. We will review and respond to removal requests and will remove or restrict Content where appropriate. We do not use facial recognition, face detection, photo tagging, or any biometric processing on Content.

9. Acceptable Use

You agree that you will not: (i) upload unlawful Content or use the Service for any unlawful purpose. We will report apparent illegal content to law enforcement as required by law; (ii) harass, threaten, defame, or promote hatred or violence against anyone; (iii) impersonate any person or misrepresent your affiliation; (iv) post another person's private information without authorization; (v) scrape, crawl, use automated means to access, reverse-engineer, or circumvent any part of the Service or its access controls; (vi) attempt to view a Family Page or Content you are not permitted to view; (vii) upload malware or interfere with the Service's operation or security; (viii) misuse another family's share link or invitation; or (ix) commercially exploit Gift List data or other users' data.

10. Gift Lists, Gifts, and Third-Party Retailers

Belovity Gift Lists are record-keeping tools. You acknowledge that: (i) Belovity sells no gift items, processes no gift payments, and is not a party to any purchase you or your guests make. Gift purchases happen on third-party retailer websites, not on Belovity. (We do charge for our own subscription plans — see Plans, Pricing, and Billing — but that is unrelated to gift purchases); (ii) Belovity records self-reported purchase markers ("I bought this") and does not verify that any purchase occurred, was completed, shipped, or delivered; (iii) prices shown are entered by users, may be inaccurate or out of date, do not include a currency indicator, and are informational only. They are not offers by Belovity or any retailer; (iv) retailer links are provided for convenience only. Belovity has no affiliation with, and does not endorse, any retailer, and earns no commission or referral fee from any purchase today. If that ever changes, we will disclose it; (v) any dispute about an order, shipping, returns, defects, or refunds is between you (or the gift-giver) and the retailer; (vi) if enabled, a Gift List shipping address (including a recipient's name) is shown to that Family Page's Admins and Followers so gifts can be sent. It is the family's responsibility to decide whether to display a shipping address; and (vii) gifting on Belovity is not anonymous. When a gift-giver marks an item purchased, the recipient family is notified in real time and can see the gift-giver's name, message, and the purchase. Gift-givers should expect their identity, message, and purchase to be disclosed to the recipient family immediately; and

(viii) the number of Gift Lists a Family Page may hold depends on its plan. A free Family Page may hold one Gift List. The Unlimited plan removes the limit. The limit counts every Gift List the Family Page holds, whether or not it is turned on, including drafts created from the browser extension. When a Family Page is at its limit, creating another Gift List is refused until an existing one is deleted or the plan is upgraded.

11. The Belovity Browser Extension

Belovity offers a companion Chrome browser extension that runs on retailer websites, captures product details on your own device, and adds items to your Gift List. The extension is distributed separately through the Chrome Web Store, and its installation and use are also governed by Google's terms and the Chrome Web Store's policies. The extension is provided "as is." These Terms govern your use of the extension to the extent it interacts with the Service; where Google's Chrome Web Store terms apply, those govern the distribution channel.

The extension is available on every plan, including the free plan. The one part of it that depends on your plan is AI product-name shortening, which requires the Unlimited plan.

The extension cannot reach your account until you connect it. Connecting it from the Browser extension connections page in your account authorizes that browser to add items to your Gift Lists on your behalf, and anything it adds is treated as done by you. A Gift List created from the extension counts toward your Family Page's Gift List limit, and the extension will be refused if the Family Page is already at that limit. An authorization is limited: it expires within 30 days whether or not it is used, and you can end it at any time from that page. You may hold up to five connected browsers at a time; connecting a sixth automatically ends the oldest connection. You are responsible for the browsers and devices you connect and for disconnecting any you no longer use or no longer control. We may end an authorization at any time, including automatically if we detect that its credentials have been replayed or otherwise misused (a brief allowance of a few seconds exists so that a dropped network response does not disconnect you).

12. Feature Availability and Changes

Features are enabled on a per-Family-Page basis. We may add, change, limit, or withdraw features at any time, and some features may become paid. We do not guarantee that any feature will remain available or free. Availability of a feature to one Family Page does not entitle any other Family Page to it.

The following capabilities are part of the paid Unlimited plan rather than the free baseline: hiding a Family Page from search, per-Follower control over which Gift Lists a Follower can see, AI product-name shortening for Gift List items, page-view and follower analytics, and holding more than one Gift List. A free Family Page does not have them. See Plans, Pricing, and Billing.

The followers-only visibility setting described in Family Page Visibility is not part of any plan and remains free, as does the ability to make a Family Page public or private, to invite and approve Followers, and to use the browser extension.

Features are enabled per Family Page, so if you own more than one Family Page, each one's capabilities depend on that Family Page's own plan.

Plans. Belovity offers a Free plan and a paid Unlimited plan.

  • Free — one Gift List, the browser extension, Follower management and approval, and a Family Page you can keep private or make public.
  • Unlimited — everything in Free, plus unlimited Gift Lists, per-Follower control over which Gift Lists each Follower can see, the ability to hide your Family Page from search, automatic AI shortening of product names, and page-view and Follower analytics.

Price. Unlimited costs USD $7.00 per month or USD $70.00 per year. Prices are in US dollars and exclusive of any taxes that may apply; we do not currently collect tax.

A subscription covers one Family Page, not your whole account. Each Family Page is billed separately and has its own subscription and its own payment method. If you own two Family Pages and want Unlimited on both, that is two subscriptions.

Only the Owner of a Family Page can manage its billing. Admins cannot subscribe, change, or cancel a plan; if a Family Page needs billing attention, an Admin is shown a notice and must ask the Owner to act.

Payment processing. Payments are processed by Stripe. You enter your card details on Stripe's own checkout page, not on Belovity. We never receive or store your full card number, expiry, or security code. From Stripe we receive and store a customer identifier, your card's brand, and its last four digits, so we can show you which card is on file. See our Privacy Policy (https://belovity.com/privacy).

Auto-renewal. A subscription renews automatically at the end of each billing period — monthly or yearly, as you chose — and your payment method is charged the then-current price, until you cancel. By subscribing, you authorize these recurring charges.

Cancelling. You cancel from the Billing page in your account, using "Manage subscription," which opens Stripe's billing portal. Cancelling stops future renewals; your Unlimited features continue until the end of the period you have already paid for, after which the Family Page moves to the Free plan. See Downgrading to Free, which describes what you must do if you hold more than one Gift List.

Deleting cancels immediately. Deleting your account, or deleting a Family Page, cancels that Family Page's subscription immediately. Because we do not issue refunds, any remaining paid time is forfeited — if you want the benefit of the period you paid for, cancel instead of deleting and wait until the period ends.

Failed payments. If a renewal payment fails, Stripe may retry it. If the subscription ends as a result, the Family Page moves to the Free plan and the restrictions in Downgrading to Free apply.

Price changes. We may change prices. We will give you reasonable advance notice, and a change takes effect at your next renewal. If you do not agree, cancel before that renewal.

Discounts and promotional codes. We may offer discounts or promotional codes at our discretion. They are personal to the recipient, non-transferable, carry no cash value, cannot be exchanged for money, may be limited in duration or quantity, and may be changed or withdrawn at any time. Using a code does not change any other part of these Terms, including No Refunds.

Changes to plans. We may change what each plan includes, as described in Feature Availability and Changes. If we materially reduce what a paid plan includes, we will give reasonable notice, and the change takes effect at your next renewal.

14. Free Trial

When you create your first Family Page, it starts on a 21-day free trial of Unlimited.

  • The trial is once per person, not once per Family Page. Any additional Family Page you create starts on the Free plan with no trial.
  • No payment method is required to start the trial, and no card is collected.
  • The trial does not convert into a paid subscription, and you are not charged when it ends. Nothing bills you unless you actively choose to subscribe.
  • We will remind the Family Page's Owner about seven days and about three days before the trial ends.

When the trial ends, the Family Page needs a decision from its Owner before it can be used again. Until the Owner either subscribes or downgrades to Free:

  • the Owner is taken to the Billing page;
  • Admins are shown a notice that the Family Page is waiting on its Owner; and
  • Followers and any public visitors cannot see the Family Page's Gift Lists.

We may change the length of the trial, or stop offering it, for Family Pages created after the change.

15. No Refunds

All payments are final. We do not issue refunds, for any reason.

This includes, without limitation: unused time on a monthly or yearly subscription; a subscription you forgot to cancel; a renewal you did not intend; a period during which you did not use the Service; dissatisfaction with the Service or with a change to it; deleting your account or your Family Page mid-period; losing access because a Family Page was suspended or terminated under these Terms; and partial periods of any kind. We do not provide credits, refunds, or prorated amounts for any of these.

Cancelling stops future charges only. It does not refund a charge already made.

Nothing in this section limits any refund or cancellation right that applicable law gives you and that cannot be waived by agreement. Where such a right applies, we will honor it.

16. Downgrading to Free

Moving a Family Page from Unlimited to Free — whether you choose to, or the trial or subscription ends — has consequences you should understand before you do it.

You may have to delete Gift Lists, permanently. The Free plan allows one Gift List. If your Family Page holds more than one, you must choose which ones to delete before the downgrade completes. Deleting a Gift List this way is permanent and cannot be undone. It removes the Gift List, every item on it including archived items, and every purchase record on it, including gift purchases made by other people. Posts that referenced the Gift List are kept but are no longer linked to it.

Paid features stop. Per-Follower Gift List permissions, AI product-name shortening, and analytics stop being available.

Your Family Page becomes visible to search again. Downgrading turns search visibility back on, and the Free plan gives you no way to turn it off. See Family Page Visibility.

Keep your own copies. If any Gift List data matters to you, export or record it yourself before downgrading. We cannot restore it afterwards.

17. Notifications and Email

The Service is notification-driven. We send transactional and notification messages by email and by web push, and we always deliver in-app notifications, which cannot be turned off. We do not send marketing or promotional email. You can control email and push notifications in the in-app preference center, but certain transactional messages (for example, confirmations related to gift purchases and sign-in links) are always sent and have no off switch. See the Privacy Policy for details.

Messages you send us. We keep any communication you send us — support requests, emails, and attachments — together with our replies, so we have a record of the exchange. See the Privacy Policy (https://belovity.com/privacy).

Billing-related messages. If you own a Family Page on a free trial, we send you reminders about seven days and about three days before the trial ends. These go to the Family Page's Owner only. We do not currently send notifications about failed payments, renewals, or cancellations, so you should not rely on Belovity to remind you that a renewal is coming; Stripe's receipts and your own records are the reliable source.

18. Intellectual Property

The Service itself, excluding user Content, including its software, design, and the Belovity name and logos, is owned by Belovity LLC and protected by law. You may not use our trademarks without permission. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

19. Copyright and DMCA

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe Content on the Service infringes your copyright, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the infringing material with information sufficient to locate it (such as a URL); (4) your contact information (address, telephone number, and email); (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

If your Content was removed, you may submit a counter-notification containing: your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and your name, address, telephone number, and consent to jurisdiction. We terminate the accounts of repeat infringers in appropriate circumstances.

20. Suspension and Termination

We may suspend or terminate your access for breach of these Terms, abuse, or where required for legal or safety reasons. Where practicable, we will give you notice, except in cases involving legal requirements, safety, or abuse. You may stop using the Service at any time. Not using the Service is not the same as deleting your account; to delete your account and data, see Deleting Your Account. Sections that by their nature should survive termination (including Content license limits, disclaimers, limitation of liability, indemnification, arbitration, and governing law) survive.

21. Deleting Your Account

You can delete your account yourself at any time:

  1. Sign in to Belovity.
  2. Go to Settings.
  3. Open the Danger Zone section.
  4. Choose to delete your account.
  5. Type DELETE MY ACCOUNT exactly when prompted.
  6. Confirm.

Deletion is immediate, permanent, and irreversible. There is no undo, no grace period, and no way to restore a deleted account.

Deleting your account cancels any subscription on a Family Page you own, immediately. No further charges are made. As set out in No Refunds, we do not refund the remainder of a period you have already paid for, so if that matters to you, cancel and wait for the period to end instead of deleting. Stripe keeps its own record of your customer and payment history to meet its legal and accounting obligations; see the Privacy Policy retention section (https://belovity.com/privacy#retention).

If you are the Owner of a Family Page, deleting your account destroys that Family Page and everything in it, for every Admin and Follower. There is no way to transfer ownership of a Family Page to someone else. Deleting your account removes the Family Pages you own and their content for everyone.

Deleting your account does remove your web push notification subscriptions, so no push endpoint for you remains on our servers.

Deleting your account does not remove everything, everywhere. In particular, it does not remove: gift-purchase records you created on other families' Gift Lists, or archived Gift List items and purchases — these are retained as part of that family's records, but they are no longer linked to your account, though the gift-giver name and message you typed remain on the record for that family; Content you contributed to Family Pages you do not own; and certain security, audit, and operational logs described in the Privacy Policy retention section (https://belovity.com/privacy#retention).

As an alternative to deleting your account, you can leave a Family Page. Leaving a Family Page immediately and completely revokes your access to it without deleting your account.

If deletion does not complete for any reason, contact alex@belovity.com and we will complete it manually. For how long we keep information and your rights, see the Privacy Policy retention and rights sections.

22. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Keep your own copies. Belovity is not a backup service. We may lose, corrupt, or delete Content, and Content may be lost when a Family Page Owner deletes their account. You should keep your own copies of any Content that matters to you.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELOVITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

24. Indemnification

You will indemnify Belovity against third-party claims arising from your Content, your breach of these Terms, or your violation of another person's rights (including a named person's privacy). This does not require you to pay our attorneys' fees beyond what the law allows, and does not apply to the extent a claim arises from our own conduct.

25. Dispute Resolution, Arbitration, and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal resolution first. Before starting an arbitration, you and Belovity agree to try to resolve the dispute informally for at least 60 days after written notice to alex@belovity.com (for you) or to your account email (for us).

Agreement to arbitrate. If we cannot resolve the dispute, you and Belovity agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the Federal Arbitration Act, and not in court, except as stated below.

Class-action and jury-trial waiver. YOU AND BELOVITY WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS. CLASS, COLLECTIVE, AND REPRESENTATIVE ACTIONS ARE NOT PERMITTED.

Delegation. The arbitrator has exclusive authority to decide all issues about the interpretation, applicability, enforceability, and scope of this arbitration agreement, except that a court decides the enforceability of the class-action waiver.

Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.

Fees. Each party's responsibility for arbitration fees will be governed by the rules of the arbitration administrator and applicable law.

30-day opt-out. You may opt out of this arbitration agreement by emailing alex@belovity.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Severability specific to this Section. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of this arbitration agreement remains in effect. If any other part of this arbitration agreement is found unenforceable, it will be severed and the remainder will continue to apply. This severability provision is specific to this arbitration Section and applies instead of the general severability clause in the General section.

26. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Subject to the arbitration agreement above, any dispute not subject to arbitration will be brought exclusively in the state courts located in the county of Belovity LLC's principal place of business, or in the U.S. District Court for the Northern District of Georgia, and you consent to those venues.

27. Changes to These Terms

We may update these Terms. We will post the updated version with a new "Last Updated" date. When we change them, existing account holders are shown the updated Terms in the Service the next time they sign in or use it, with a link to read them in full, and are asked to accept. We record that acceptance, including the version accepted and the date you accepted it. Until you accept, you cannot continue using the Service. If you do not want to accept an updated version, email alex@belovity.com and we will delete your account. Your continued use of the Site after we post an updated version means you accept it. Prior versions are available on request at alex@belovity.com.

28. General

These Terms and the incorporated Privacy Policy and Cookie Policy are the entire agreement between you and Belovity. Except as stated in the arbitration Section, if any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger or sale. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). We may give notices through the Service or to your account email; you give notice to alex@belovity.com. These Terms create no third-party beneficiaries. Headings are for convenience only.
